Organizer
Miles & More GmbH, MAC Main Airport Center, Unterschweinstiege 8, 60549 Frankfurt/Main, Germany (hereinafter referred to as "Organizer" or "Miles & More") is organizing a sweepstakes (hereinafter "Sweepstakes") within the Uptrip App (hereinafter "App" or "Uptrip") during the specified period. The organizer of the sweepstakes is solely Miles & More.
Promotion Period and Participation
The sweepstakes period begins on April 20, 2025 (00:00 CEST) and ends on May 20, 2025 (23:59 CEST).
Eligibility, Execution, and Handling
a. All Uptrip users who are at least 18 years old at the time of participation, reside in the European Union, and are not excluded by the following conditions or by the organizer may participate.
b. Employees of the Lufthansa Group and their relatives are excluded from participation.
c. The organizer reserves the right to exclude individual participants for valid reasons. In such cases, prizes may also be revoked and reclaimed retrospectively.
d. Participation is free of charge. Participation and chances of winning are not dependent on the purchase of goods or services. Any user-incurred costs for participation, such as internet or mobile charges, are borne by the participants themselves.
e. Participation occurs by scanning NFC tags located in selected areas inside and outside the security zones of the following airports: Frankfurt (FRA), Munich (MUC), Vienna (VIE), Berlin (BER) and more to be released soon. A prerequisite is that the Uptrip App is installed on an NFC-enabled smartphone. Scanning triggers a “Spin the Wheel” feature in the app, awarding users a digital Uptrip collection card which may potentially secure a prize. The number of prizes is technically limited; distribution is randomized via an automated system. Each user may participate only once.
f. Winners are determined automatically and at random by the Uptrip system. The following main prizes are available: 3x Senator Status10x 10,000 Miles & More Miles All other participants receive a virtual Uptrip collection card
g. Winners of the Senator Status or Miles will be notified on May 21, 2025. A Miles & More account is required to receive these prizes. The Miles & More terms and conditions apply. Prizes are non-cashable, non-transferable, and cannot be exchanged.
h. In case of technical errors or attempted manipulation, the organizer reserves the right to exclude participants or repeat the sweepstakes. Legal recourse is excluded in these cases as well.
i. By participating, users accept these terms and conditions and confirm they have read the privacy notice.
Data Protection
The organizer processes personal data for the execution and handling of the sweepstakes. The following personal data is collected: profile information in the Uptrip app including first and last name, date of birth, Miles & More service card number, email address, and information about the scanned NFC tag. The legal basis is contract performance under Art. 6 (1)(b) GDPR. Your data will be deleted once it is no longer required for these purposes, unless longer retention is required by law. Amendments and Termination
The organizer reserves the right to modify, suspend, or terminate the sweepstakes at any time for compelling reasons. The validity of the remaining provisions shall remain unaffected by the invalidity of individual clauses.
Limitation of Liability
The organizer is liable only in cases of intent or gross negligence. Liability for injury to life, body, or health remains unaffected. Exclusions of liability do not apply in cases of negligent breach of obligations essential for the proper conduct of the contract, where breach endangers the contract purpose and on which the participant regularly relies. In such cases, liability is limited to foreseeable, contract-typical damages. No liability is assumed for technical disruptions beyond the organizer's control.
Miscellaneous
German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Legal recourse is excluded. Winnings may be subject to income tax; proper taxation is the sole responsibility of the winner.
