Conditions of participation for the “Senator Raffle” competition
1. Organizer
Lufthansa Innovation Hub GmbH, Brunnenstraße 19-21, 10119 Berlin, Germany (hereinafter “LIH”) is organizing a competition (hereinafter “Competition”) in the Uptrip App (hereinafter “App” or “Uptrip”) during the specified period. LIH is the sole organizer of the competition.
2. Promotion Period and Participation
The period during which the competition is organized begins on 15.05.2024 (00.01 CET) and ends on 15.06.2024 (23.59 CET).
3. Eligibility, Implementation and Processing
a. All Uptrip users who have reached the age of 18 and are resident in the European Union or Switzerland at the time of participation and who are not excluded from participation in accordance with the following conditions or by the LIH can take part in the competition.
b. Employees of the Lufthansa Group and their relatives are excluded from participation.
c. LIH is entitled to exclude individual participants if there are justified reasons for doing so. In such cases, winnings may also be subsequently withdrawn and reclaimed.
d. Participation in the competition is free of charge. The chance of winning and participation are independent of the purchase of goods or services. Participants must bear the user costs for participation, such as for internet connection or mobile telephony, themselves.
e. The prerequisite for participation in the competition and the drawing of the prize is that Uptrip users redeem the Senator competition collection. The Senator Prize Draw Collection is a collection consisting of an Uptrip Anniversary Card, no further cards are required to complete it. The Senator Prize Draw Collection can be redeemed up to five times per participant. Each time the Senator Prize Draw Collection is redeemed, a ticket will be created in the name of the user and entered into the prize draw. The winners will be drawn at random from all registered participants. The prize draw will take place after the end of the campaign. The prize will then be automatically credited to the Miles & More mileage account of the winner or a person nominated by the winner within four weeks of the draw taking place.
f. As an alternative to participating in the Senator Prize Draw by completing the Senator Prize Draw Collection, Uptrip users have the option of completing the Anniversary Gift Collection with an Uptrip Anniversary Card. Any two Uptrip cards are also required to complete the Anniversary Gift Collection. Upon completion and redemption of the Anniversary Gift Collection, 365 miles will be credited to the Miles and More account of the respective Uptrip user. This Anniversary Gift Collection can only be redeemed once per Uptrip user. The respective Anniversary Card can only be used once. Users can therefore either take part in the Senator competition or receive the credit. The respective Uptrip Anniversary Card can only be used and redeemed once.
g. By participating in the prize draw, participants accept these conditions of participation and confirm that they have read the data protection information. Each person can enter the competition with a maximum of five (5) entries.
4. Winnings
Three Senator statuses will be raffled off. There is no entitlement to another prize. It is not possible to change or exchange the prize. Cash payment of the prize (even in part) is not possible. Prize entitlements are transferable to other natural persons, but cannot be redeemed for vouchers and cannot be used separately. In the unlikely event that the prize is unavailable, LIH reserves the right to replace it with a prize of equal or greater value at its own discretion.
5. Data Protection
As the organizer of the competition, LIH processes personal data in order to carry out and process the competition. LIH collects the following personal data from the user data: Surname, first name, date of birth, Miles & More service card number and e-mail address. The legal basis for processing is contract fulfillment, Art. 6 para. 1 sentence 1 lit. b GDPR. Your personal data will be deleted as soon as it is no longer required for the stated purposes. However, we may have to continue to store your data until the expiry of the retention obligations and periods issued by the legislator or supervisory authorities, which may result from the German Commercial Code and the German Fiscal Code and usually amount to six to ten years. In addition, we may retain your data until the expiry of the statutory limitation periods (i.e. usually three years; in individual cases, however, up to 30 years), insofar as this is necessary for the assertion, exercise or defense of legal claims. The corresponding data will then be routinely deleted. As a data subject, you can exercise the following rights if the respective legal requirements are met: right of access, Art. 15 GDPR, right to rectification, Art. 16 GDPR, right to erasure (“right to be forgotten”), Art. 17 GDPR, right to restriction of processing, Art. 18 GDPR, right to data portability, Art. 20 GDPR, right to object, Art. 21 GDPR. Right to object, Art. 21 GDPR: You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Art. 6 para. 1 sentence 1 lit. e or f GDPR. We will no longer process the personal data concerning you unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims. You can object to the processing of your personal data at any time. To exercise your rights, you can use our contact form “GDPR information request” at https://www.uptrip.app/contact. In order to be able to process your request and identify you, we would like to point out that we will process your personal data in accordance with Art. 6 para. 1 lit. c) GDPR. Furthermore, you have the right to lodge a complaint with a supervisory authority, Art. 77 GDPR i.V.m. § 19 BDSG. 6. Changes to the Conditions of Participation and Termination of the Competition
LIH reserves the right to change the conditions of participation at any time. Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected. Furthermore, LIH reserves the right to terminate or interrupt the competition at any time without prior notice. This applies in particular to any reasons that would disrupt or prevent the competition from running as planned.
7. Limitations of Liability
LIH shall not be liable for damages that may arise in particular due to errors, delays or interruptions in the use of the website, in the transmission, in the event of malfunctions of the technical equipment and service, due to incorrect content, loss or deletion of data, due to viruses or in any other way during participation, unless such damages are caused by LIH intentionally or through gross negligence. The above exclusions of liability shall not apply in the event of injury to life, limb or health. Furthermore, the exclusions of liability shall not apply in the event of negligent breach of obligations, the fulfillment of which is essential for the proper performance of the contract, the breach of which jeopardizes the achievement of the purpose of the contract and on the observance of which the participants regularly rely; in such cases, LIH shall only be liable for foreseeable damage typical of the contract. LIH cannot guarantee the availability of the offer at all times.
8. Other
These conditions of participation and the legal relationship between the participants and Lufthansa are subject exclusively to German law, excluding the UN Convention on Contracts for the International Sale of Goods. Legal recourse is excluded. We would like to point out that winnings from this promotion may be subject to income tax. Any taxes on winnings are to be borne by the winner and paid to the relevant tax office.
